Land settlement case of Chitral- The bench extended the injunction already granted

PESHAWAR: The Chitral land settlement case came up for hearing before a divisional bench of the Peshawar High Court on Wednesday.
Additional Advocate General Atif Ali Khan pleaded before the bench consisting of Justice Ishtiaq Ibrahim and Justice Abdul Shakur for the vacation of the injunction already granted by the High Court which prevents closing of the settlement process and handing over of the settlement records to the Senior Member Board of Revenue and other respondents in the case.
Barrister Asad-ul-Mulk objected to the vacation of the injunction stating that if the Government was truly interested in the vacation of the stay then it should submit its comments in the case whereafter the case will be argued and if found bereft of merit then dismissed. He implored that vacation of the interim relief already granted would render the petition infructuous.
Justice Ishtiaq Ibrahim stated that the case obviously has significance otherwise why would the Chief Justice transfer it from Dar-ul-Qaza Swat to the principal seat of the High Court Peshawar and thus it could not be allowed to become infructuous.
The bench extended the injunction already granted and directed the Additional Advocate General to personally ensure that the Government files its comments before the next date of hearing.
